While filling a tank is within the regulations, it will still remain in the ground. The advisable way would be to remove it completely. Once a tank is removed and the steel recycled, it's just gone forever.

no law that we know of which says you MUST remove the tank - - might be difficult to sell the house

The regs do not demand removal of the underground tank - Our experience is that once it is removed it cannot return to haunt a sale or impact your like..... left in the ground, even if emptied.. it is still there

Even though you may have mitigated potential liability, you will probably save money on your home owners insurance, and if you ever want to sell your house, you will probably have to remove it.
Also note that if any oil did leak out, it will still continue to soak further into the ground, which will just make things worse over time.
